Article 1: General provisions

The MD Mods e-commerce website, an independent business in a secondary profession with its registered office at Clement Vanophemstraat 58, 3090 Overijse, VAT BE 0737.950.759, offers its customers the opportunity to purchase products from its online store.

These General Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via the MD Mods web store, the Customer must explicitly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Client are excluded, unless they have been accepted in advance, in writing and expressly by MD Mods.

Article 2: Price

All prices stated are expressed in EURO, always excluding VAT and all other taxes or taxes that are to be paid by the Customer. These prices are subject to possible errors.

If delivery, reservation or administrative costs are charged, this will be stated separately.
The price indication refers only to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind MD Mods. MD Mods is only bound to an obligation of means as to the accuracy and completeness of the information provided. MD Mods is in no way liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about, for example, lengths, colors, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.

The offer is valid as long as supplies last and can be modified or withdrawn at any time by MD Mods. MD Mods cannot be held responsible for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

Article 4: Quotations / Orders

The offers of MD Mods are only valid if in writing, during the period stated in the offer and under the conditions stated in the offer. If the quotation does not mention a term, these are valid for an indefinite period.

Orders can be placed in writing, via the Internet on the website with URL “www.mdmods.be”, by email or by telephone, but are only binding if accepted by MD Mods by means of an order confirmation. Please review the order confirmation and notify MD Mods immediately by registered letter of any discrepancies. If the Customer does not do this within 3 calendar days after the date of the Order Confirmation, it will be irrefutably assumed that the order confirmation is identical to the Customer's order.

Article 5: Price and payment

Prices and taxes of MD Mods products and services are stated on the invoice. Payment is made no later than the stated date on the invoice. MD Mods can suspend the delivery of products or services until full payment. In the event of non-payment of the invoice within the stated payment term, the amount of the invoice due by operation of law and without the need for notice of default will yield MD Mods a conventional default interest of 12% per year. In addition, all amounts due will be increased by a compensation of 10% on the invoice amounts with a minimum of EUR 50 per invoice, by way of compensation for extrajudicial collection and administration costs. All this in addition to and above all costs of a legal dispute and its execution, as well as all costs and fees of the lawyer that MD Mods must appeal to both for extrajudicial and legal steps to collect. In the event of non-payment of the invoice within the stated payment term, the balance due under all other invoices, irrespective of their due date and which do not themselves expire, will become fully payable by operation of law, plus the aforementioned fees. If agreed in writing, the payment term can be set at a maximum of 30 days after the invoice date.

Article 7: Complaints

The Customer must inspect our products for visible damage or defects within 24 hours of receipt. Complaints in this regard are inadmissible if they are not clearly addressed to MD Mods in writing within 24 hours after delivery or execution. No complaint regarding our invoices is admissible if it is not addressed to MD Mods in writing within 2 calendar days after the invoice date. Unless agreed in writing by us, no return will have legal consequences; the mere acceptance of returned goods is always subject to all reservations and never implies our agreement with the return. The existence of complaints does not release the Customer from the obligation to pay our invoices on their due date.

Article 8: Affect of validity - non-renunciation

If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by MD Mods to enforce or exercise any of the rights set forth in these Terms will never be considered a waiver of such provision and will never affect the validity of these rights .

Article 9: Advances and Creditworthiness

MD Mods has the right to request advance payments or the full agreed invoice amount prior to the delivery of a product or the performance of a service. Without prejudice to the right to request advances, MD Mods may also demand full guarantees or even full payment if confidence in the Customer's creditworthiness is shaken, such as due to late payment of an invoice. Your refusal to accept a bill of exchange or by protesting a bill of exchange, by requesting terms, by applying for a court agreement, by acts of legal action against the Customer and / or by any other identifiable event. In all cases, MD Mods also has a lien on all goods owned by the Customer, up to our full payment.

Article 10: Change of conditions

These Terms and Conditions are supplemented by other terms and conditions explicitly referred to, and MD Mods' general terms and conditions of sale. In the event of contradiction, the present Conditions prevail.

Article 11: Force majeure

In case of force majeure, MD Mods has the choice to either terminate an unfinished agreement and to charge for the products and services already delivered, or to suspend the delivery or execution until the circumstances that caused the force majeure no longer present. Force majeure shall be deemed to be any circumstance independent of our will and which prevents the normal performance of the agreement, including inadequate supply. The following circumstances, among others, will be considered as force majeure: strikes, terrorism, war, problems with suppliers, transport or production, exchange rate fluctuations, governmental or regulatory action and natural disasters. If the force majeure situation has lasted two months, either party can terminate the agreement. Under no circumstances is any party entitled to compensation.

Article 12: Evidence

The Customer accepts that electronic communications and backups can serve as evidence.

Article 13: Applicable law - Disputes

Belgian law applies, with the exception of the provisions of private international law on applicable law.
These General Terms and Conditions are subject to Belgian law and to the exclusive jurisdiction of the competent court of Leuven.
